ARTICLE 3 - ORDERS

When you place an order, you make an offer to purchase. GAVLON reserves the right to accept or decline your order at its discretion. Your order is deemed accepted once GAVLON confirms it in writing (confirmation email). We must receive and process your payment before your order is confirmed. Please review your order carefully before submitting it. If your order is declined, changed or cancelled, we will try to contact you using the details provided. Your purchases are subject to our Refund Policy (https://gavlon.com/policies/refund-policy). You represent that your purchases are for personal use and not for commercial resale.

ARTICLE 4 - PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged is the one in effect at the time of your order, shown in your confirmation email. Unless expressly stated otherwise, displayed prices do not include shipping costs or any customs duties or import taxes. Where a promotion applies, its own terms prevail over these Terms in case of conflict. You agree to provide accurate and current payment information. You represent that: (i) your payment details are accurate; (ii) you are authorised to use the payment method; (iii) you will pay the amounts due at the displayed prices, including shipping and applicable taxes.

ARTICLE 5 - SHIPPING AND DELIVERY

Stated delivery times are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs formalities or any event beyond our reasonable control. ARTICLE 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, text, images, graphics, videos and content, as well as their design and arrangement, are the exclusive property of GAVLON or its licensors and are protected by Swiss and foreign intellectual property laws. These Terms allow you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, republish or transmit any content of the Services without our prior written consent. GAVLON's names, logos and slogans are trademarks of GAVLON; you may not use them without written permission. Shopify's trademarks belong to Shopify. All rights not expressly granted are reserved.

ARTICLE 7 - OPTIONAL TOOLS

You may use third-party tools through the Services that we do not control. These tools are provided "as is" and "as available", without warranty. We disclaim all liability arising from your use of optional third-party tools. You are responsible for accepting the terms of the relevant third-party providers. Any new features offered in the future will be subject to these Terms.

ARTICLE 8 - THIRD-PARTY LINKS

The Services may contain links to sites operated by third parties. We are not responsible for their content or accuracy. If you access these sites, you do so at your own risk. Any complaint regarding third-party products or services must be addressed directly to the relevant third party.

ARTICLE 9 - RELATIONSHIP WITH SHOPIFY

GAVLON is powered by Shopify, which enables us to offer the Services. All sales are, however, made directly with GAVLON. You acknowledge that Shopify is not responsible for any aspect of the sales between you and GAVLON. You release Shopify and its affiliates from any claim arising from your purchase from GAVLON.

ARTICLE 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy (https://gavlon.com/policies/privacy-policy), and some may be subject to Shopify's Privacy Policy (https://www.shopify.com/legal/privacy/app-users). By using the Services, you acknowledge that you have read these policies.

ARTICLE 11 - FEEDBACK

If you send us ideas, suggestions, reviews or any other content ("Feedback"), you grant us a worldwide, non-exclusive, perpetual and sublicensable licence to use, reproduce, modify, publish and display it for any purpose, including commercial. You represent that you hold the necessary rights to such Feedback, that it complies with these Terms and does not infringe any third-party rights. We reserve the right to correct them and to change or cancel an order in case of inaccurate information, at any time and without prior notice, including after you have submitted your order.

You are prohibited from using them: (a) for any unlawful or malicious purpose; (b) in breach of any applicable law or regulation (international, federal, cantonal or local); (c) to infringe the intellectual property rights of GAVLON, Shopify or third parties; (d) to harass, abuse, defame or harm others; (e) to transmit false or misleading information; (f) to send non-compliant content; (g) to send spam or unsolicited communications; (h) to impersonate any person; (i) to interfere with others' use of the Services. You also agree not to: introduce malicious code; copy or exploit any part of the Services; collect others' personal data; engage in phishing; use bots, scrapers or automated means to access the Services; or circumvent security measures. We may suspend or terminate your account in case of breach.

ARTICLE 14 - AGENTS

14.1 This section applies if you use or deploy an Agent to access the Services. An "Agent" means any software or service acting autonomously or semi-autonomously on a person's behalf, without direct supervision.
14.2 No Agent may access the Services unless it continuously identifies itself and operates in accordance with section 14.4. No Agent may access the Services if we have prohibited it from doing so.
14.3 We may limit, including by technical means, how Agents access the Services.
14.4 Agents must: (i) indicate in their HTTP/HTTPS requests that they come from an Agent and disclose its name ("Agent/[name]"); (ii) not conceal that they are an Agent nor circumvent CAPTCHAs; (iii) answer honestly prompts intended to distinguish human from machine; (iv) not circumvent access-control measures.

ARTICLE 15 - TERMINATION

We reserve the right to terminate this agreement or your access to the Services at any time, at our discretion and without notice. You remain liable for amounts due up to termination. Provisions that by their nature should survive termination (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law) will remain in effect.

ARTICLE 16 - DISCLAIMER OF WARRANTIES

Information provided through the Services is for informational purposes. Unless expressly stated by GAVLON, the Services and products are provided "as is" and "as available", without warranty of any kind, to the extent permitted by law. We do not warrant that the Services will be uninterrupted, secure or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so this exclusion may not apply to you. This clause does not limit any mandatory consumer rights you may have under applicable law.

ARTICLE 17 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, GAVLON and its partners, officers, employees, agents and service providers (as well as Shopify and its affiliates) shall not be liable for any indirect, incidental, special or consequential damages, including loss of profits, revenue or data, arising from your use of the Services or any product obtained through them. This limitation does not apply to liabilities that cannot be excluded by law, nor to mandatory consumer rights.

ARTICLE 18 - INDEMNIFICATION

You agree to indemnify and hold harmless GAVLON, Shopify and their affiliates from any third-party claim, including reasonable legal fees, arising from (1) your breach of these Terms, (2) your violation of any law or third-party rights, or (3) your use of the Services.

ARTICLE 19 - SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, it will apply to the maximum extent permitted by law and the unenforceable part will be severed, without affecting the validity of the remaining provisions.

ARTICLE 20 - WAIVER; ENTIRE AGREEMENT

Failure to exercise a right does not constitute a waiver of that right. These Terms and the policies posted on this site constitute the entire agreement between you and us and supersede any prior agreement.

ARTICLE 21 - ASSIGNMENT

You may not assign this agreement without our prior written consent. We may assign or transfer these Terms and our rights and obligations without your consent.

ARTICLE 22 - GOVERNING LAW AND JURISDICTION

These Terms are governed by Swiss law, excluding its conflict-of-law rules. Any dispute falls under the jurisdiction of the courts of the Canton of Vaud, at GAVLON's registered seat in Lausanne. Mandatory consumer-protection provisions in force in the customer's country of habitual residence remain reserved.

Headings are for convenience only and do not affect the interpretation of these Terms.
